Ok, Roe v Wade allows abortion up to 'viability'. Great?
Now what, exactly, is 'viability'? In the terms of modern medicine for fetal development it is viability to be born and exist outside of its birthing host.
In this society we have a name for what that birth gives you: Citizenship. Lovely change of gears, isn't that? Totally orthogonal to the damned idiots vituperating on this for decades, now.
So Roe v Wade is an attempt to tell the States that at a certain developmental stage a fetus is viable for... Citizenship! Which then gives the full due process protection of all laws under the Constitution.
Unfortunately the Supreme Court realized it could not do this as it would be stepping on the State's right to determine this. So they left this dangling language and a 'figure it out yourself' feeling.
So, instead of stating something clearly and getting a revolution as they usurped State's rights, they left Roe v Wade trying to say something but without saying it and then trying to tell you: naughty, naughty to try and use this logic for anything *else*. Damn them to tweak Our noses like that!
The idea, then, is to be *naughty* and use the exact conception and enshrine it in each State with the consent of the Governed so that actual birth is taken out of the granting of full due process rights. One will still have a *birthday* for actual accounting of everything else, but the full rights and protections of the Constitution are granted at the time of 'viability' set by the State, so as to exist with the state of the art of such things.
By doing *this* the "pro-choice" people get to shut up. Mind you, they may want to start keeping logs on days when they have unprotected sex... and have actual manufacturers get the idea that when protection is used it needs some form of verification. But the *marketplace* can do that!
Now, the "pro-life" folks get a chance to sit down and put their money where their beliefs are. Fund gestational sciences HARD to move that 'viability' date ever downwards until it is as close to conception as modern science can get it. They now have a final, achievable goal that uses the good and old fashioned method of the Republic to those who have a belief that is not backed by something solid and supported that everyone can agree upon: prove it.
That means no more asserting, no more vigils, no more harassment, no more threats... you have a peaceful and just means to achieve your goals. It will not get you *instant* satisfaction. So sorry, this is a Republic, not a Monarchy.
If this had been started in 1975, then there is no telling where the medical science would be today, after 30 years of close and intense work and scrutiny to actually understand human reproduction. It would be far ahead of where it is today, that is to be sure. Three decades of screaming and yelling, gone for naught.
Save those of us looking on getting tired of hearing BOTH SIDES.
Anything to get them to be quiet would be a joy and wonder to the Citizenry as a whole. And to start draining the vitriol in the public forum that is the lifeblood of the United States would be the best thing to happen since this damn decision was made.
